Identification of guests

In order to make use of the properties, guests are required to present their identification document in order to complete the corresponding arrival report in conformance with current regulations regarding registers and arrival reports for travellers arriving at hotel establishments and other similar places.

Payments

In order to be valid, the first payment must be received within two working days either via wire transfer or card payment. Please quote the number or reference of your rental or reservation contract upon arrival. All payments will be confirmed via an email to your address once the payment receipt has been received. All credit card payments are made on a secure web through SSL

The price offered is per overnight stay in accordance with article 32 of Law 13/2011 of 23 December. In all cases, the price includes the following: water supply, electricity, heating, refrigeration, cleaning prior to arrival and the use of bedclothes, towels and kitchenware.

The price is that which is agreed in the rental contract and it cannot be reduced on the basis of future offers.

Terms & Conditions

1. Arrival: The property will be available from 16:00 (4:00 pm) on the day of arrival, unless a different arrival time is specified in the special terms and conditions agreement for the reservation.

Upon arrival at the property, the tenant will receive information on how to operate the household appliances and other instruments as necessary. They will also be provided with information about house rules and the use of shared facilities in the block or development.

The tenant will verify that the household appliances function correctly and will inform Rincón Rent of any deficiencies within 24 hours after their arrival at the property.

2. Departure: The property should be vacated by 10:00 (10:00 am) on the day of departure, unless otherwise agreed.

3. Late arrival: Arrivals after 22:00 (10:00 pm) are only possible if advance notice is given and are subject to a “late arrival” fee which will be charged as an extra.

4. Arrival directions: Precise directions to the property will be sent to the tenant in the confirmation email.

5. Keys: A representative of Rincón Rent or the owners will be present at the property to hand over the key.

6. Occupancy: The property may not under any circumstances be occupied by a greater number of people than the number initially indicated in the reservation. Occupancy by more people than those initially agreed may only be permitted in the case of an agreement between both parties, and in such case an extra amount should be paid as a supplement.

Furthermore, the additional guests should report expressly to the Rincón Rent reception (at the Centro Idea, Carretera de Mijas, Km. 3.6 de Mijas) in order to complete the Hotel Registry for the National Police. It is possible, following the payment of a sum to be determined in the special terms and conditions agreement, that representatives of Rincón Rent may travel to the property expressly in order to collect signatures from the additional guests not initially indicated in the reservation.

7. Pets: Pets are not permitted under any circumstances, unless expressly agreed in advance between both parties.

In cases where pets are allowed on the property, it will be necessary to pay a supplement that will be specified in the special terms and conditions agreement. In cases where the property does not permit pets, failure to comply with this condition will serve as grounds for termination of the contract between both parties without any right to compensation whatsoever.

8. Services/special requests: Rincón Rent endeavours to meet the needs of its clients, and if the tenant or guest has any special request or requires an additional service, we will be at their disposal to try and attend to any requests insofar as it is possible and in order to make their stay as pleasant as possible.

9. Other services: if any additional service pertaining to the property, such as the internet, satellite tv, hot tub, etc, does not work or is out of service, Rincón Rent will immediately get in touch with technical services in order to repair it. No refunds will be given in such cases.

10. Third party services: Rincón Rent will in no way be responsible in the event that third party stores, leisure services, attractions, etc. in the area close or make changes to their services, opening hours, etc. This includes shopping centres, shops, restaurants, cyber cafés, bicycle rental services, laundry facilities, recreational parks, golf courses, etc.

11. Rules of the owners/property: Hosting parties is not permitted in the properties. Neighbours and shared services must be respected and there should be no noise during siesta hours and at night.

12. Deposit: The deposit is to guarantee that the property is returned in good condition. The deposit will be returned within ten working days following departure provided that there are no damages. We will inspect and inventory the property before and after your stay. The tenant should cover the cost of any lost items, including bedclothes, towels, keys, remote controls for the garage door or any other door-opening remote controls, cards or passes for access to the car park or swimming pool. The tenant may be required to pay an additional fee in the event that an exceptional degree of cleaning is required due to dirty dishes, furniture moved from its original position, rubbish not taken out to the designated receptacles, etc. The deposit will also be lost in the event that any of the house or community rules are violated, including rules regarding the community pool, if applicable. Any damage, mistakes and / or defects in the accommodation must be notified to Rincón Rent within 24 hours of arrival.

13. In cases where the property rented is located in an area accessed by gravel roads or roads that are unpaved: It is assumed that the tenant has experience driving on this type of road. Gravel roads in mountainous areas can be narrow, steep and difficult, and may not have safety barriers, etc.

14. In case of emergency: The tenant will facilitate access by the property’s representatives immediately and on request so that they may resolve the incident or undertake repair.

15. Any disturbances resulting from work by third parties: Rincón Rent is not responsible for any noise that may be caused by construction or maintenance work being undertaken in the area surrounding the property or for any disturbances caused by external factors or other factors beyond control.

16. Complaints form: Rincón Rent has a complaints and claims form available to guests.

Cancellation

  1. Cancellations made 31 days or more prior to the arrival date: If the total amount has been paid, 70% of the sum received will be returned.
  2. Cancellations made less than 30 days prior to the arrival date: Such cancellations will not be reimbursed. Cancellation insurance is recommended.
  3. The first payment has the effect of a reservation confirmation by the tenant and is non-refundable.
  4. If the property reserved is not available for occupancy due to reasons beyond our control, Rincón Rent reserves the right to relocate the guest to an alternative accommodation of similar conditions at no additional cost to the tenant. If it is not possible to offer an alternative accommodation, the reservation will be cancelled and the entire amount paid for the reservation will be refunded. Nonetheless, if the property has been reserved through a third party (for example, any online platform such as Booking, Expedia, AirBnB, HomeAway, SpainHolidays, etc.), the obligations will be those expressly established by the third party with regards to payments, reservations, changes, cancellations, etc.

Liability

  1. The tenant is liable for any damages to the property and communal areas surrounding the property that have been caused by the tenant, their guests or by third parties.
  2. Rincón Rent, the partners of Rincón Rent and the property owners will under no circumstances be liable for the loss or damage of the tenant’s belongings or personal property.
  3. It is the responsibility of the tenant to take out adequate travel insurance which covers accidents, third party liability, etc. Neither Rincón Rent nor the property owners will be liable under any circumstances for accidents suffered by the tenant or by their guests.

Industrial and intellectual property

Unless otherwise indicated, the software required for our services or which is made available or used on our Platform and the intellectual property rights (including copyright) of the content and information, such as the material on our Platform, is owned by Rincon Rent S.L., its suppliers or distributors.

Rincon Rent S.L. exclusively retains ownership of all rights, titles and interests (all intellectual property rights) the regarding the appearance (including infrastructure) of the Platform on which the service is made available (including guest reviews and translated content) and you are not entitled to copy, scrape, link to, publish, promote, sell, integrate, use, combine or otherwise utilise the content (including translations and guest reviews) or our brand without our express written consent. To the extent that you (completely or in part) wish to use or combine our (translated) content (including guest reviews) or own any intellectual property rights on the Platform or any (translated) content or guest reviews, you assign and transfer all intellectual property rights to Rincón Rent S.L. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database rights).

We are highly committed to protecting and defending intellectual and industrial property rights. We therefore inform you that:

Under no circumstances may it be understood that users are given rights of any kind to exploit the content shown, beyond those which are strictly necessary for the viewing of such content.

We guarantee that all the content that we place at your disposal is completely original and complies with current national legislation, and is protected by intellectual property rights. In cases where we do not own such content, we have obtained all the rights for its public communication, distribution and/or reproduction.

All logos, trademarks and trade names presented via the website or the platform are our property, or, if applicable, belong to third parties who have allowed us to use and/or exploit them.

Under no circumstances may browsing the website imply the waiver, transmission, licence or transfer in whole or in part of the intellectual or industrial property rights, unless otherwise stated in writing.

None of the content hosted on the platform may be downloaded, reproduced or used on any other device or in any other place other than Rincón Rent, unless we have provided the means to do so.

For security reasons, the use of frames or mechanisms which alter or vary the design, original configuration or content of the website is not permitted.

With regards to links or hyperlinks, it is possible that we may facilitate access to the websites by independent third parties who are directly related to the advertising displayed and reproduced on the website or platform. As these pages are not owned by Rincon Rent S.L. and are therefore beyond our control, we are not responsible for their content and/or functionalities.

Similarly, users undertake not to delete or alter any distinctive sign used on the website without prior authorisation, such as, but not limited to, trademarks, trade names (graphics, logos, etc.), copyright, and other information identifying our rights or third party rights incorporated in Rincón Rent.

Jurisdiction

These general contract terms and conditions are governed by specific applicable legislation, Decree 28/2016 of 2 February, on Properties used for Tourism and the amendment of Decree 194/2010, of 20 April, on Tourist Apartment establishments, as well as Law 13/2011 of 23 December on Tourism in Andalusia.

In the event of any dispute or disagreement that may arise regarding the interpretation and fulfilment of this Contract, both parties agree to accept the jurisdiction and competency of the Courts and Tribunals of Málaga, waiving their own jurisdiction if it is different.

The tenant accepts these contractual conditions upon making payment.
